OR Available ONLY through the WCA. =========================== Court says Axiom claims about NASA were false A Georgia District Court has ruled against Axiom Worldwide, Inc., in a civil case accusing the company of making false claims that its diagnostic device, the DRX 9000, has an association with the American space program NASA. In the Judgment, the court stated that "Preventing the consumer confusion associated with Defendants’ (Axiom) use of false statements to promote the DRX 9000 are in the public interest." As a result, it prohibited Axiom from: (a) Falsely representing that the DRX 9000, or any portion or feature thereof, is patented by Defendant Axiom; (b) Falsely representing that the DRX 9000 is FDA “approved”; or (c) Falsely representing that there is any affiliation between or between NASA and the DRX 9000, including, but not limited to, claims that: (i) the DRX 9000 resulted from a joint collaboration between Axiom and NASA engineers; (ii) NASA engineers developed the DRX 9000; (iii) part of the DRX 9000 was discovered by NASA; (iv) the DRX 9000 contains or embodies NASA technology; or (v) NASA endorses the DRX 9000. Smith was forced to drop the attack articles that he posted on his internet site. Initially, in a display of defiance, JC Smith, DC ‑‑ operator of the "stoprondberg" website and the architect of the attack campaign against Terry A Rondberg, DC, and other subluxation‑based chiropractic leaders ‑‑ refused to take any corrective actions or retract his false statements.
